In college contribution cases the facts of the relationship between parent and child, the amounts required for funding of education and the ability of the parties to fund education at the choice schools of the child are certainly relevant and open to ultimate determination of the court, and must be carefully considered by attorneys in advocating their positions.

In cases where you are faced with the challenge of a disbelieving jury pool, and low impact damage photos, you must aggressively attack the entire premise of the defense’s case. That attack must begin with the very first opportunity that you are given in openings and continue through to the very end.  Make the jury believe that the judge agrees with the plaintiff.

For the legal profession, which owes a special duty to the people of this country to seek equity and justice, we have to do better. It’s not enough to not do bad things. We must strive – for ourselves, for our firms and or the integrity of our profession – to get to the “next level.” We need to work together to acknowledge, identify and eliminate institutional bias in the profession.

The Meadowlands Seminar 2021 will take place Wednesday – Friday, December 8 – 10, 2021 as an in-person event.

The three-day event will take place at the Hilton Meadowlands Hotel in East Rutherford, NJ under safety protocols established by the Educational Foundation Board of Trustees for all Educational Foundation events.

NJAJ’s amicus curiae efforts once again have produced positive results for New Jersey residents – this time in the case of New Jersey Division of Child Protection and Permanency v. J.R.-R.where the New Jersey Supreme Court unanimously ruled that in child abuse and neglect cases the burden of proof is on the state to prove the cause of the abuse or neglect and common law doctrine should not serve to shift that burden upon accused parents or caretakers.

The late Kenneth G. Andres, Jr. Esq., has been selected as the 2021 NJAJ recipient of the Professional Lawyer of the Year Award. We mourn his passing, but we honor his memory and achievement by selecting him as NJAJ’s recipient of this prestigious award posthumously. The award is presented annually by the New Jersey Commission on Professionalism in the Law.

Yesterday, the New Jersey Department of Banking and Insurance issued an Order regarding the disclosure of policy limits disclosures. The Order requires all private passenger automobile insurers to submit email addresses to DOBI, where they will receive policy limit requests pursuant to P.L. 2021, c. 177. This Order from the Department of Banking and Insurance is a requirement of the bill S-1558, that went into effect on July 22, 2021 when Governor Murphy signed it into law. The law requires auto insurers to disclose policy coverage limits to an injured party when requested by an attorney.
